UNEXPIRED TERM FULFILLMENT

 

 

Vacancies in the membership of the East Baton Rouge Parish School Board caused by death, resignation, or otherwise, shall be filled within twenty (20) days by the remaining members of the School Board, by appointment of a qualified person for the unexpired term.  If the School Board does not fill the vacancy within the allotted time, the governor shall appoint a person to fill the vacancy.

 

If the unexpired portion is more than one (1) year, however, a special election shall be called by the School Board in accordance with and on a date stipulated by state law.  If a special election is called, the appointed member shall serve until a successor is elected and has taken the prescribed oath of office.

 

In addition to the above, a vacancy shall be deemed to have occurred when a member becomes domiciled outside or changes his/her domicile from the district he/she represents.

 

Multiple vacancies shall be filled according to state statutory provisions.

 

VACANCY REPLACEMENT PROCESS

 

When a vacancy occurs in the membership of the School Board, the remaining members of the School Board shall, within twenty (20) days, declare in an official meeting that the vacancy has occurred and proceed to appoint a person who meets the qualifications of the office to fill the vacancy.

 

During the meeting, each candidate shall be given an opportunity to make a brief introductory statement (2 to 3 minutes) before the School Board.

 

School Board vacancies shall be filled in the following manner:

 

  1. The School Board President shall accept nominations by other School Board members of qualified candidates, which nominations do not require a second.

  2. Once all candidates have been nominated, a vote shall be taken after the nominations are closed and after the audience is given an opportunity to comment.

  3. If only one candidate is nominated then the School Board may vote using the electronic voting machine with those in agreement voting affirmatively.  If more than one candidate is nominated, the School Board shall be polled and each member shall state the name of the candidate for whom he/she is voting.  School Board members may vote for only one (1) nominee.

  4. If a candidate receives the votes of a majority of the members of the total School Board on the first ballot, that candidate shall be declared elected and seated.  Five (5) votes shall constitute a majority.

  5. If no candidate receives a majority of the votes of the total School Board on the first ballot, a second vote shall be taken between the two (2) candidates receiving the most votes.  If there is a tie vote between more than two (2) candidates for the highest number of votes, or between two (2) or more candidates for the second highest number of votes, all such candidates shall be included in the runoff election.

  6. In the runoff election, the candidate receiving the greatest number of votes shall be declared elected, provided however, that such candidate must have received the vote of a majority of the total School Board.

  7. In the event of a tie vote, or in the event of no nominee receiving the favorable vote of a majority of the total School Board, voting shall continue until a nominee receives the vote of a majority of the total School Board.
