INDIVIDUALS WITH DISABILITIES GRIEVANCE PROCEDURES

 

 

The East Baton Rouge Parish School Board shall direct that anyone who wishes to file a complaint alleging discrimination on the basis of disability in employment practices and policies or the provision of services, activities, programs, or benefits by the East Baton Rouge Parish Public School System, shall do so in the following manner:

 

  1. The complaint should be in writing and contain information about the alleged discrimination such as name, address, and phone number of the complainant and location, date, and description of the problem.  Alternative means of filing complaints, such as personal interview or a tape recording of the complaint, will be made available for persons with disabilities upon request.  A complaint form is available by calling the ADA Coordinator.

  2. The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than sixty (60) calendar days after the alleged violation to

  1. Within fifteen (15) calendar days after receipt of the complaint, the ADA Coordinator shall meet with the complainant to discuss the complaint and possible resolutions.  Within fifteen (15) calendar days after the meeting, the ADA Coordinator shall issue a written determination as to the validity of the complaint and a description of the resolution, if any, and, where appropriate, in a format accessible to the complainant, such as large print or audio tape.

  2. The complainant may request a reconsideration of the matter if he or she is dissatisfied with the resolution.  The request for reconsideration shall be made within fifteen (15) calendar days of the date of the written determination issued by the ADA Coordinator and, in writing or by alternative means, to the Superintendent.

  3. Within twenty (20) calendar days after receipt of the request for reconsideration, the Superintendent or his/her designee shall issue a written determination concerning the request for reconsideration or in an alternative format, if required.  The Superintendent's or designee's written determination shall be a final resolution of the complaint.

 

The right of a person to pursue a complaint filed hereunder shall not be impaired by the person's pursuit of other remedies such as filing of an ADA complaint with the responsible federal department or agency.

 

The ADA Coordinator shall maintain the files and records of the East Baton Rouge Parish School Board relating to complaints filed for at least three (3) years.
