IN-SCHOOL SUSPENSION
The East Baton Rouge Parish School Board shall authorize and permit, in accordance with state law, the principal or designee to discipline students through the use of in-school suspensions. In-school suspension may be used to remove a student from the student’s normal classroom setting while continuing to provide instruction to the student and maintaining the student under supervision of appropriate school staff and teachers within the assigned school. The assignment of a student to in-school suspension shall be made by the principal or designee and the decision is final. There is no appeal available.
Prior to any in-school suspension, the school principal, or designee, shall advise the student of the particular misconduct of which the student is accused as well as the basis for such accusation, and the student shall be given an opportunity at that time to explain the student’s version of the facts. If the principal or designee decides to proceed with the in-school suspension, the principal shall follow the procedures outlined in the Handbook and inform the parent or legal guardian by telephone or electronic means.
Attendance during in-school suspension shall be mandatory. Students shall be given an opportunity to make up school work while assigned an in-school suspension.
Students who are assigned an in-school suspension may be sent to one of the following, depending on the severity of the offense:
Time-Out Room (TOR)
Short-term corrective action for disruptive behavior, up to a one-day suspension, in the student's home school. This intervention removes the student from the assigned regular classroom and requires supervised learning away from other students and school activities. Referral of students to a Time-Out Room shall generally be made by the teacher of the student but may be made by the principal or designee. Offenses which warrant referral to Time-Out Rooms and procedures for making such referrals are outlined in the Handbook. Parents shall be informed of the student’s assignment to a Time-Out Room.
Behavior Clinic
The clinic provides an alternative to the routine procedure for dealing with disruptive students. Its operation is based upon the concept of positive intervention and behavior modification theory and techniques. Alternative forms of discipline or clinic may be used when deemed necessary by the principal. Students may be assigned to the clinic for committing minor offenses as designated in the Handbook.
Failure to appear at clinic on the assigned date shall result in an out-of-school suspension unless the student has a valid excuse. Students with valid excuses shall attend makeup sessions of the clinic. Behavior clinic shall be conducted after school hours for a period of at least one hour and forty-five minutes. Parents shall be informed of child's assignment to the clinic. Parents shall be required to pick up students promptly following the clinic.
Detention
Detention means activities, assignments, or work held before the normal school day, after the normal school day, or on weekends. Failure or refusal by a student to participate in assigned detention may subject the student to immediate out-of-school suspension. Assignments, activities, or work which may be assigned during detention include but are not limited to counseling, homework assignments, behavior modification programs, or other activities aimed at improving the behavior and conduct of the student.
Failure to appear at detention as scheduled on the assigned date and time shall result in an out-of-school suspension unless the student has a valid excuse. Parents shall be informed of child's assignment to detention. Parents shall be required to pick up students promptly following the detention.
IN-SCHOOL SUSPENSION OF STUDENTS WITH DISABILITIES OR EXCEPTIONALITIES
In-School suspension of students with disabilities or exceptionalities, or an Individualized Education Program, or Section 504 Individualized Accommodation Plan shall be to the extent allowed by applicable state or federal law and regulations or the provisions of the student’s specific plan.
