Levels of Disciplinary Responses

Classroom, class behavior and behaviors at school-related activities subject to Discipline Options/Responses are not limited to those provided. Serious or repeated violations may result in a more severe response or referral to Code of Conduct Regulations options and responses, including recommendations for expulsion. 

Starting at the beginning of each school year, in general, staff shall implement disciplinary options/responses to a student in a progression beginning with the least severe disciplinary response. However, stricter discipline may be initially imposed if it is an appropriate disciplinary response to an infraction. Disciplinary options/responses a teacher or employee may use include:

a. Nonverbal redirection and/or teacher proximity;
b. Verbal/individualized redirection or reprimand;
c. Conduct a teacher-student conference;
d. Contact parent by email, note or telephone call;**
e. Loss of privileges
f. Implementation of PBIS Classroom Minor Behavior Tracking Form;
g. Written notification to parents of disruptive or unacceptable behavior with a copy provided to the principal;
h. Referral of the student to a school counselor, I CARE Specialist, social worker, mental health professional and/or certified school psychologist;
i. Oral or written reprimand;
j. Assignment of remedial work;
k. Impose other disciplinary measures approved by the principal and the faculty of the school and in compliance with School Board policy.

*When a student’s behavior prevents the orderly instruction of other students or poses an immediate threat to the safety or physical wellbeing of any student or teacher or when a student violates the school’s code of conduct, the teacher shall have the student immediately removed
from the teacher’s classroom and placed in the custody of the principal or designee.
** Two attempts to contact parents should be made prior to the loss of privileges, with proper notification.

General disciplinary options/responses by principal for student removed from a classroom:
In general, starting at the beginning of each school year, staff shall implement disciplinary options/responses to a student in a progression beginning with the least severe disciplinary response. However, stricter discipline may be initially imposed if it is an appropriate disciplinary response to an infraction. The disciplinary response depends on, in part, the infraction, previous actions, and the seriousness of the misbehavior. Acts of misconduct include those student actions that interfere with the orderly educational process in the classroom, at the school, on a school bus, or at a school-sponsored function.

After involvement by the principal or designee, a student in kindergarten through grade five removed from a class shall not be permitted to return to the class for a least 30 minutes unless agreed to by the teacher initiating the disciplinary action.

A student in grades six through twelve removed from a class by a teacher shall not be permitted to return to the class during the same class period unless agreed to by the teacher initiating the disciplinary action. Additionally, the student shall not be readmitted to the class until the principal has implemented at least one of the following disciplinary measures:

a. Conferencing with the principal or designee;
b. Detention;
c. Referral to school counselor, I CARE Specialist, social worker, mental health professional, and/or certified school psychologist;
d. Peer mediation;
e. Referral to the school building level committee (SBLC);
f. Restorative justice practices;
g. Loss of privileges;
h. Excluding from extra-curricular activities, such as field trips, and commencement exercises/award ceremonies;
i. In-school suspension;
j. Alternative site suspension;
k. “Behavior”,” behavioral”, and/or “conduct” contracts;
l. Assignment to Time-out Room (in-school suspension);
m. Assignment to Behavior Clinic (in-school suspension);
n. Initiate expulsion proceedings for infractions involving weapons or drugs;
o. Initiate expulsion proceedings when the safety of students and staff has been put in jeopardy;
p. Referral for assignment to an alternative setting;
q. Require completion of all assigned school and homework which was assigned during a period of suspension;
r. Any other appropriate disciplinary actions determined by the principal or designee with the concurrence of the teacher or building level committee;
s. For any bullying, investigate and report as required by La. R.S. 17:416.14. See Section Seventeen; or
t. Restricted access to the virtual learning environment.

For students who experience multiple behavioral incidents or disciplinary referrals, the principal or designee shall consider a referral to the school building level committee (SBLC). If disruptive behavior persists, the teacher may request that the principal transfer the student into another setting.

Upon the third removal from the same classroom, the teacher and the principal shall discuss the disruptive behavior patterns of the student and the potentially appropriate disciplinary measure before the principal implements a disciplinary measure. In addition, a conference between the teacher or other appropriate school employee and the student’s parent or legal guardian is required prior to the student being readmitted into that same classroom. Such conference may be in person or by telephone or other virtual means. When such conference is required, the school shall give
written and/or electronic notice to the parent.

More serious incidents of student misconduct may result in a referral to the principal or designee. The disciplinary response depends on, in part, the infraction, previous actions, and the seriousness of the misbehavior. These acts of misconduct include those student actions that interfere with the orderly educational process in the classroom, at the school, on a school bus, or at a school- sponsored function.

Level 3 Infractions are misconduct for which a principal may discipline a student by detention, by in-school suspension, by alternative site suspension, by recommending an expulsion or suspending a student from riding on a school bus. In general, disciplinary options/responses for misconduct should be imposed in a progression, beginning with the least severe appropriate response. However, stricter discipline may be initially imposed if it is an appropriate disciplinary response an infraction. The possible options or responses for a principal or designee may include any of the following:

a. referral to school level building committee (SBLC);
b. referral to counseling, behavior and/or conduct contracts;
c. assignment to Behavior Clinic;
d. in-school suspension;
e. detention;
f. alternative site suspension; or
g. assignment to alternative placement or recommend expulsion.

Conferences to Discuss Referral to Support Services: As described in Section 12, after two (2) suspensions that remove a student from the student’s assigned or enrolled school, a school principal or designated employee shall schedule a conference with the student’s parent or legal guardian to discuss the student’s behavior and counseling as well as the referral of the student and family to support services for assessment and treatment.

Discretionary Expulsions: All recommendations for expulsion shall be reserved for infractions that either threaten the health and safety of students and staff or infractions that involve weapons and/or drugs. All other types of infractions require the prior administration of interventions/responses in accordance with the minor levels of infractions in this code, but the accumulation of minor infractions may be the basis of an expulsion referral.

For students in Pre-K through fifth grade, after being suspended on three (3) occasions for committing any of the infractions enumerated in this Handbook (tardies or dress code violations do not count) during the same school year, may on committing the fourth such infraction be recommended for expulsion from all public schools of the School System until the beginning of the next regular school year—or at least for one complete school semester. A student in grades six through twelve who is suspended a third time within the same school year for any offense, excluding those related to dress codes or tardiness, shall be immediately recommended for expulsion. See La.
R.S. 17:416(C)(2)(c). All expulsions are reserved for the major behavioral infractions, such as misconduct involving weapons, drugs, or when the safety of students and staff has been put in
jeopardy and when the referral meets the criteria for discretionary expulsions. See La. R.S.17:416(L).

Level 4 conduct requires a principal or designee to immediately suspend the student and to recommend expulsion. If a student is found to have committed a Level 4 infraction by a Disciplinary Hearing Officer, the Disciplinary Hearing Officer may not assign a lesser punishment.

The School Drug Task Force and the District Attorney shall be notified when a student is in possession of drugs, intending to distribute drugs, or distributing drugs in a Drug Free Zone, or is in possession of a knife, firearms or explosives.

Additional Disciplinary Response Information

Detention means activities, assignments, or work held before the normal school day, after the normal school day or on weekends. Assignments, activities, or work may be but are not limited to counseling, homework assignments, behavior modification or other activities aimed at improving the behavior and conduct of the student. Detention may be imposed by the principal or designee after a conference with the student and the student’s parent or guardian. Failure or refusal by a student to participate in assigned detention may subject the student to immediate alternative site placement.

The student is removed by the principal or designee from their normal classroom setting but is maintained under supervision within the school. Students participating in in-school suspension shall receive credit for work performed during the in-school suspension. The student’s parent or guardian shall be notified of an in-school suspension by telephone or other virtual means, or the principal or designee may require an in- person conference. A student who fails to comply fully with the rules for the in-school suspension may be subject to immediate alternative site suspension.

Removal from school can be one of three types:

a. Short-term alternative site (formerly out-of-school) suspension – means the removal of a student from all classes of instruction on the student’s assigned or enrolled public school grounds and all other school-sponsored activities for a period of one (1) to ten (10) days and assigned to a Discipline

b. Long-term alternative site (formerly out-of-school) suspension – means the removal of a student from all classes of instruction on the student’s assigned or enrolled public school grounds and all other school-sponsored activities for a period of eleven (11) to twenty (20) days, which can only be imposed by a Hearing Officer in lieu of a recommended expulsion. The student is assigned to a Discipline

c. Expulsion – a removal from all regular school settings for a period of not less than one school semester or longer. During an expulsion the student shall be placed in an alternative educational

A recommendation for expulsion may include any conduct stated in the previous sections for which the principal or designee may suspend the student, place the student into either an in-school suspension or an alternative site, or recommend expulsion if the conduct is serious. The principal or other appropriate administrator makes the disciplinary determination based on the severity of the misconduct and the previous record of behavior. Expulsions must still be reserved for the major behavioral infractions such as misconduct involving weapons, drugs, or when the safety of students or staff has been put in jeopardy.

Students with disabilities have certain rights which may affect the School System’s implementation of suspension and expulsion determinations and educational recommendations and decisions regarding services, placement, and site of educational service delivery during a period of expulsion. Suspensions within the school year must be considered regardless of the school(s) (e.g., charter, other district school) which the student attended during the school year.

Possession of Marijuana (First Time)

A student found guilty of being in possession of marijuana, tetrahydrocannabinol (THC), any chemical derivative thereof, or any synthetic or related compounds.

Any student, on the first occurrence of being in possession of marijuana on school property, school bus, or at a school-sponsored event, may be recommended for expulsion at the principal’s discretion. Expulsion hearing officers also have discretion to accept, modify, or deny any expulsion referral for this specific infraction. Any subsequent occurrence during any student’s educational career, prior to graduation from high school, shall be addressed in accordance with La. R.S. 17:416(B) and the other drug possession infractions listed in this Handbook.

Possession or Distribution of Drugs - 1

Any student in K - 5th grade who is found guilty by a Disciplinary Hearing Officer of being in possession of any illegal narcotic, drug, or other controlled substance on school property, on a school bus, or at a school-sponsored event.

Student shall be expelled for a minimum period of two complete school semesters. Under the above circumstances, students with disabilities will be disciplined under Louisiana's Regulations for Implementation of the Children with Exceptionalities Act (La. R.S. 17:1941 et seq.); Title 28, Part XLIII, Bulletin 1706 Subpart 1 - Regulations for Students with Disabilities, Sections 530-537 or Section 504 of the Rehabilitation Act of 1973. As outlined in Sections Six and Twenty-Eight, the use, possession, or distribution of any form of marijuana, tetrahydrocannabinol (THC), or related chemical compounds is prohibited. This includes, but is not limited to, THC-infused foods and beverages, vaporizers, e-cigarettes, oils, tinctures, topicals, and any other products containing THC.

Possession or Distribution of Drugs - 2

Any student in 6th - 12th grade who is found guilty by a Disciplinary Hearing Officer of being in possession of any illegal narcotic, drug, or other controlled substance on school property, on a school bus, or at a school-sponsored event.

Pursuant to a hearing, the student shall be expelled from school for a minimum of a period of four complete school semesters. La. R.S. 17:416(C)(2)(a). Under the above circumstances, students with disabilities will be disciplined under Louisiana’s Regulations for Implementation of the Children with Exceptionalities Act (La. R.S. 17:1941 et seq.); Title 28, Part XLIII, Bulletin 1706 Subpart 1 – Regulations for Students with Disabilities, Section 530-537 or Section 504 of the Rehabilitation Act of 1973. As outlined in Sections Six and TwentyEight, the use, possession, or distribution of any form of marijuana, tetrahydrocannabinol (THC), or related chemical compounds is prohibited. This includes, but is not limited to, THC-infused foods and beverages, vaporizers, e-cigarettes, oils, tinctures, topicals, and any other products containing THC.

Threat of Violence - 1 (Battery or Assault)

Battery, assault or making statements threatening physical harm (see Section Twenty-Eight-Definitions) to a teacher, instructor, administrator, bus driver, staff person or employee of the school system.

Students may be disciplined for commission of this infraction even if the behavior occurs off school property. A student who commits this infraction shall be referred for an expulsion. If the expulsion recommendation is confirmed by a hearing officer, the expulsion shall be no less than two complete school semesters in duration. The student shall be immediately removed from the school premises without the benefit of the alternative site placement procedures. The student shall be immediately removed from the school premises without the benefit of the alternative site placement procedures; however, the necessary notifications and other procedures shall be implemented as soon as practicable.

The student shall not be readmitted to the school of the assaulted or battered or threatened employee until all hearings and appeals have been exhausted. If found guilty of violating La. R.S. 14:34.3 or 14:38.2 or both by a court of competent jurisdiction or as a result of an expulsion hearing of committing a battery or an assault on any school employee or a threat to harm any school employee, the student shall NOT be assigned to attend or attend the school to which the assaulted, battered or threatened employee is assigned, unless the school system has no other school of suitable grade level for the pupil to attend or if the assaulted, battered or threatened employee agrees in writing to allow the student to return to the same school.

Possessing, displaying, using, or allowing any of the following is prohibited during the instructional day and on school buses: 1) electronic telecommunication devices, including any facsimile systems, radiopaging services, mobile telephone services, intercoms, electro-mechanical paging systems, beepers, or cellular telephones; 2) iPods or similar music players; 3) gaming devices; or 4) earbuds, in-ear, or over-the-ear audio devices or similar devices. (See policy JCDAE)

Bringing to school any electronic device, including but not limited to the prohibited electronic devices listed above, is solely at the student’s risk. Neither the School Board nor the school shall be liable for any lost, stolen, or damaged device including any confiscated device. If a student brings an electronic telecommunication device or other prohibited electronic device to any District school building or on the grounds thereof or on any school bus used to transport public school students, the electronic device shall be turned off and properly stowed away for the duration of the instructional day and is prohibited from being turned on and used while on any school bus used to transport public school students or otherwise during the instructional day while at school. Any violation of this rule constitutes the unauthorized use, possession, or operation of an electronic communication device. This rule does not apply to District-issued electronic devices that are authorized for student use. The unauthorized use, possession, or operation of an electronic device shall result in confiscation. Upon the first incident of the unauthorized use, possession, or operation of an electronic device, the principal or designee will confiscate the device from the student and notify the parents, within 24 hours of confiscation, to come to the school and pick up the device. In the event of any additional incidents of the unauthorized use, possession, or operation of an electronic device, the device will be confiscated by the principal or his or her designee and the student may be subject to, at the discretion of the principal or his or her designee, additional disciplinary measures enumerated in Level 2 in Section Ten–Levels of Disciplinary Responses–of this handbook.

found carrying or possessing a knife which exceeds two and one-half inches in length, the principal or designee may but shall not be required

The East Baton Rouge Parish School System is advising families that school bus transportation may experience delays during the Friday afternoon commute home because of weather and road conditions across the parish. Transportation staff members are working to safely transport students while navigating possible heavy traffic, flooded areas and impacted roadways caused by
changing weather conditions.

District officials said student safety remains the top priority as drivers continue routes throughout the parish. The district appreciates the understanding and cooperation of families and the community during the weather event.
